1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the ListingOS mobile application and related services (the “Service”) provided by ListingOS Inc. (“ListingOS,” “we,” “us,” or “our”).
By creating an account or using the Service, you agree to be bound by these Terms, our Privacy Policy, and our End User License Agreement. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and a licensed real estate professional (or working under one) to use the Service. By using ListingOS, you represent that you meet these requirements and that the information you provide is accurate.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:
- Provide accurate and complete registration information
- Keep your login credentials secure
- Notify us immediately of any unauthorized use of your account
- Not share your account or allow others to access it without authorization
4. Subscription Plans and Payment
4.1 Plans
ListingOS offers multiple subscription tiers (Starter, Pro, Team, Brokerage, and Enterprise) with varying features and limits. A free tier with limited functionality is also available. Plan details and pricing are displayed in the app and on our website.
4.2 Billing
Subscriptions are billed through Apple’s App Store on a monthly or annual basis. By subscribing, you authorize recurring charges. All payments are processed by Apple and subject to Apple’s terms.
4.3 Cancellation and Refunds
You may cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period. Refund requests are handled by Apple in accordance with their refund policies.
4.4 Price Changes
We reserve the right to change subscription pricing. Existing subscribers will be notified at least 30 days before any price increase takes effect. Continued use after the change constitutes acceptance.
5. Professional License
ListingOS offers a one-time Professional License purchase that grants permanent access to core features. The Professional License is:
- Non-transferable and tied to your account
- Valid for the lifetime of the product
- Subject to reasonable usage limits as described at the time of purchase
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
- Post false, misleading, or fraudulent listing information
- Violate fair housing laws, anti-discrimination laws, or MLS rules
- Upload content that infringes on intellectual property rights of others
- Attempt to reverse engineer, decompile, or disassemble the Service
- Use automated systems (bots, scrapers) to access the Service
- Interfere with or disrupt the Service or its infrastructure
- Share, resell, or redistribute AI-generated content in bulk for commercial purposes unrelated to your real estate business
7. Your Content
7.1 Ownership
You retain ownership of all content you upload or create through the Service, including listing data, photos, documents, and lead information (“Your Content”).
7.2 License to ListingOS
By uploading Your Content, you grant ListingOS a non-exclusive, worldwide, royalty-free license to use, store, process, and display Your Content solely for the purpose of providing and improving the Service. This license terminates when you delete Your Content or close your account.
7.3 AI-Generated Content
Content generated by ListingOS’s AI features (listing descriptions, social media posts, follow-up messages) is created for your use. You own the AI-generated content and are responsible for reviewing it for accuracy before publishing. ListingOS does not guarantee that AI-generated content is free from errors.
7.4 Published Content
Content you publish through listing landing pages, agent pages, or social media integrations is made publicly available at your direction. You are solely responsible for the accuracy and legality of published content.
8. Intellectual Property
The Service, including its design, code, features, branding, and documentation, is owned by ListingOS Inc. and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.
9. Third-Party Services
The Service may integrate with third-party services (MLS providers, social media platforms, AI providers). Your use of these integrations is subject to their respective terms and privacy policies. ListingOS is not responsible for third-party services.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted or error-free
- AI-generated content will be accurate, complete, or suitable for any particular purpose
- The Service will meet all of your requirements
- Any data or information will be stored without loss
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LISTINGOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO LISTINGOS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless ListingOS, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
13. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination:
- Your right to use the Service immediately ceases
- You may request export of Your Content within 30 days
- We will delete your data in accordance with our Privacy Policy
14. Dispute Resolution
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in the State of California. You agree to waive any right to a jury trial or to participate in a class action.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
16. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes through the app or by email at least 30 days in advance. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
17. General
- If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
- Our failure to enforce any provision does not waive our right to do so later.
- These Terms, together with our Privacy Policy and EULA, constitute the entire agreement between you and ListingOS.
